You bought it from Amazon right, you can ask Steam Support or Amazon to remove the key from his/her account, then you can use the key again

user was last faked being BigHeart http://steamcommunity.com/id/waszegrysajuzmoje (not sure if this can be changed?) sent him a Toy Soldiers key and he logged off and took the key, sould've checked better all the signs where there but I had been lucky in the few trades I've done.
